Here is how we can check on
the expiry of LPG cylinders:

On one of three side stems of the cylinder,
the expiry date is coded alpha numerically
as follows:
A or B or C or D
and some two digit number following this,
e.g. D06.

The alphabets stand for quarters -
1. A for March (first quarter),
2. B for June (second quarter),
3. C for September (third quarter), &
4. D for December (fourth quarter).
The digits stand for the year till it is valid.
Hence D06 would mean December quarter of 2006.
Please return back the cylinder that you get with an expired date.
They are prone to leaks and other hazards.

This second example of D13 allows the cylinder to be in use until December 2013.

Safety Alert !!! Phone Scam

Its all started when I received a call from someone claimed that he was Maxis asking me to shutdown phone for 2 hours for 3g update to take place. As I was rushing for a meeting, I did not question any shutdown my cell phone.

After 45 minutes I feel very suspicious since the caller did not even introduce his name. I quickly turned on back my cell phone back and I received several numbers of call; few numbers from my family members and the other numbers was from the number that call me before; 3954380.

I called my parents and I was shocked that they sounded very worry asking me whether I am safe. My parents told me that they received a call from someone claimed that they have me with them and asking for money to let me free.

The call was so real and my parents even heard my voice crying out loud asking for help. My parent was at the bank waiting for next call to proceed for money transfer. I told my parents that I am safe and asking them to lodge a police report.

Right after that I received again call from the guy asking me to shutdown my cell phone for another 1 hour which this time I refused to do so and hung up. They keep calling my cell phone until the battery run down. I myself lodge a police report and was informed by the officer that this kind of scam always reported. MOST of the cases reported that the victim already transferred the money! And it is impossible to get back the money. Bank can only returned back the money if the owners of the account agree to do so or there is a court order.

Guys, be careful that this kind of scam might happened to any of us!!!

Those guys are so professional and very convincing during calls. If you asked to shutdown your cell phone for updates by the service provider, ASK AROUND! Your friend should receive the same call.

Any Customer Service should introduce their NAME AT THE BEGINNING of the call. Ignore them if you don't get a name at the beginning of the call. If you received instructions from unrecognized number/person that you are not sure, make your own judgment. The BEST is DO NOT RESPONSE

If you cannot pickup your loved one's call, DO GIVE A CALLBACK immediately! Update your loved one with ALTERNATE CONTACT wherever you are

Understanding The Difference between RON92, RON95, RON97 and RON99

The Difference between RON92, RON95, RON97 and RON99

Many said that RON92 oil is the older oil, only suitable for older cars
or for cars that uses carburetor only. There are also some that said
that RON92 oil will make the engine dirty and also said that RON92 oil
is less powerful compared to RON97 and RON99. Before you make any false
assumptions, let us see what the real meaning of RON is.

RON stands for Research Octane Number. Octane number or octane rating
refers to the gasoline ability to withstand auto ignition (knocking)
inside the engine. Higher octane number refers to higher ability of the
oil to fight auto ignition. In other words, it means that RON95 is
harder to ignite compared to RON92.

Different vehicles are designed to be use with different octane number
of oil. Higher octane number oil is basically designed for high
performance vehicles such as sport vehicle and racing vehicle. Why is
that so? This is to avoid premature ignition of oil inside the engine
because of auto ignition, which happens before the spark plug ignite the
fuel. This phenomenon is known as knocking. Knocking is not wanted
because it reduces the performance of vehicle.

The right usage of octane number based on design and adjustment of
engine will maximize the performance and effectiveness of the vehicle.
Modern vehicles are equipped with knock sensor which enables it to
adjust its combustion timing automatically according to the oil octane
number to avoid knocking or premature ignition of oil.

Not all vehicles require high octane number petrol. You can check your
vehicle fuel requirement inside the guide book of your vehicle or you
can simply check the minimum Octane Rating at the back of the fuel lid
cover of your vehicle. Most cars can still use RON92.

Higher RON number does not means that it is more powerful. It means that
it is harder to ignite. It will also cost you more.

Higher RON may not result in better performance, it all depends on the compression ratio of the enigine in your car. Most of our cars have a compression ratio in between 9:1 and 10:1. Those who are driving super car, you might see a compression level of as high as 12:1 in your engine. In US, leaded fuel has an octane rating of RON110.

Bank ATM's Converted to Steal IDs of Bank Customers

A team of organized criminals are installing equipment on legitimate bank ATM's in at least 2 regions to steal both the ATM card number and the PIN. The team sits nearby in a car receiving the information transmitted wirelessly over weekends and evenings from equipment they install on the front of the ATM (see photos). If you see an attachment like this, do not use the ATM and report it immediately to the bank using the phone on the front of the ATM. The equipment used to capture your ATM card number and PIN are cleverly disguised to look like normal ATM equipment. A "skimmer" is mounted to the front of the normal ATM card slot that reads the ATM card number and transm its it to the criminals sitting in a nearby car. At the same time, a wireless camera is disguised to look like a leaflet holder and is mounted in a position to view ATM PIN entries.The thieves copy the cards and use the PIN numbers to withdraw thousands from many accounts in a very short time directly from the bank ATM.

Bankruptcy Infomation On The Spot

The Insolvency Department of Malaysia (JIM) will soon provide up-to-date information of a persona's bankruptcy status to all commercial banks and relevant gorverment agencies. Datuk M Kayveas, deputy minister in Prime Minister's Department, said JIM was in process of creating links with the courts to capture bankruptcy discharges as and when the courts issued them. Kayveas addes that JIM's computer system would also be linked with National Registration Department, Bank Negara Malaysia's Central Credit Reference Information System (CCRIS) and, eventually, the Immigration Department. " When this system is made available, the commercial banks won't have to use private companies like CTOS sdn bhd to get information. They can rely on us 100%, and further we only charge RM 10 and not RM 15 as is done by private companies ," He said.

Sale Of Property Of A Deceased Person

a) Who Can sell a deceased's Property ?
The personal representaive of the estate of a deceased who left a Will is call executor whereas the personal representative of a deceased who died without a will is call an administrator.
Only personal representative of a deceased's estate will have the capacity to enter into a sale & purchase agreement to disposeof deceased's property.
Any disposal of property by personal representative in contravention of the Probate and Administration Act 1959 shall be voidable and may be set aside by the beneficiary.
It is also to noted that a benefiaciary of a deceased's estate has not capacity to enter into any sale and purchase agreement to dispose of the deceased's property.

b) Where there is more than one personal representative
all the personal representatives of a deceased will have to agree and sign the sale and purchase agreement. In the absence of consensus of mind among the personal representatives for the aforesaid transaction, directions of court are required.

c) Grant of Probate Or Grant of Letters of administration extracted from court
It is important that the personal representative has extracted the grant of Probate or Grant of Letters of administration from the court at the time of signing of the sale and purchase agreement. Without the Grant of Probate Or Grant of Letters of administration, the property cannot be registered in the name of the executor or the administrator and as a result of which, the instrument of transfer executed by the executor or administrator in favour of a purchaser cannot be registered in the land office when the time comes for the completion of the sale and purchase agreement.

d) Whether application to court for sanction necessary
In the case of an executor, the Probate and administration Act provides that the executor may sell the deceased’s property unless there is restriction in the deceased’s will for the executor to do so. In such circumstances, the executor needs not apply to court to empower him to sell the deceased’s property.
Notwithstanding the aforesaid statutory provision, it has been the practice of some land offices that unless the deceased’s will expressly confer powers to the executor to sell the deceased’s property, those land offices will not register instrument of transfer signed by the executor in favour of a purchaser without an order of court authorizing the executor to do so. It is prudent for a purchaser to check with his lawyer the practice of the land office concerned and prepare he sale and purchase accordingly.
In the case of an administrator, the probate and administration Act requires the administrator to apply to court to empower him to sell the deceased’s property.

e) Conditional Contract
It is common practice that when an order of court is required, the executor or the administrator will enter into a conditional sale and purchase agreement subject to the order of court being obtained within a certain period of time and to provide for the termination of S & P if the order of court cannot be obtained.
It is important for the purchaser to make sure the completion date is calculated from the date his lawyer received the sealed copy of the order of court as the instrument of transfer needs to be accompanied by the sealed copy of order of court when it is presented to the Land office for registration.

f) Beneficiaries’ Interest Versus Purchaser’s Interest
It has been decided by the court that a purchaser under a conditional contract was perfectly well aware that hia contact subject to the court’s approval and that the purchaser has taken the risk of losing their bargain if the court refused to grant such an approval. The Court, in considering the personal representative’s application for sanction to sell the deceased’s property, must protect the right of beneficiaries as opposed to the interest of the purchasers.

g) Best Possible price
It is the duty of the personal representative to obtain the best possible price. The Court is concerned that the purchase price is a reasonable one not at the time of the sale and purchase agreement but the time of hearing of the application.
There are cases where the court refused to sanction the sale by personal representative when the beneficiaries objected on the ground that the purchase price in the S & P is below market value.
The Court had held that when most of the beneficiaries had not been consulted nor their consent been obtained, the personal representative should have applied the common sense rule of calling for a valuation report. That would have assisted the personal representative in considering whether the purchase price was reasonable as the best possible price.

h) Beneficiaries’ Consent
One of the most common grounds to support such an application would be that all the beneficiaries of the deceased’s estate consented to the sale.
The Beneficiaries’ consent will have direct bearing on the outcome of the hearing of such an application. The Court has decided that where all the beneficiaries are of sound mind and above 18 years old and have consented to the sale, the court will be entitled to assume that the price offered is the best obtained.

Two-Year Defeact Liability Period For House

The Defect Liability period for new house will extended by six months to 24 Months. The amendment to the law, to be implemented this month (April 2007), will form part of new sale and purchase agreement (S &Ps).It provides better protection for property buyer and tightens housing policies. The Housing Ministry is in the process of gazetting provisions in the housing Development ( Control and Licensing) Act 1966, which, among others, gives house buyers the right to nullify their S&Ps if the housing project encounters problems. The amendment to be law, also known as Act 118, seeks to permit house buyers to take legal action against developers without the consent of the relevant financial institution or housing loan provider. House buyers can file complaints with the tribunal to claim for late delivery or defect liability after the amended act is fully implemented.

Purchasing a New Property

When a purchaser buys a new property, he is often told that the sale and purchase agreement (SPA) is a "Standard agreement".This article attempt to explain the legal Implication of having signed the SPA.

New Properties available for sale can either fall within or outside the purview of the housing Development (Control & Licensing) Act 1966 (HDA 1966). The test will be whether the property falls within the definition of "housing accommodation" which in general is a building wholly of principally constructed or intend for human habitation. Under the Housing Development (Control & Licensing) Regulations 1989, the prescribed format known as Schedule G is for landed property and Schedule H is for Condominium, apartment of flats (hereinafter both the 'schedule G and H SPA').

Any amendment to the terms of the schedule SPA requires the written consent of the Controller of Housing.

A property constructed or intended for human habitation can only be offer for sale to the public after the developer's license and an advertising permit.

The Schedule SPA does not apply to properties like commercial properties which include serviced apartment, strata offices, commercial lots , factories etc.

There are a number of differences between the Schedule SPA and a Non-Schedule SPA, and the illustration here not exhaustive but mere examples.

Date For Delivery
Under the Schedule SPA, the effective date the purpose of the computation of the date of delivery of vacant possession is 24 months from the deposit is first paid to the developer for a Schedule G agreement, and 36 months for a Schedule H agreement.
In the case of a Non-Schedule SPA, the effective date does not commence until the occurrence of certain events, E.g the approval of building plans, which the developer commonly refers to as "unconditional date'. The completion date may be extended for reason which developer claims to be not within its control. As the 'unconditional date' is often not known, it is almost impossible to compute the delivery date for delivery vacant possession.

Payment
The purchase price to be paid under the Schedule SPA, consists of progress payment after the architect has certicied that particular stage of the work has been completed.
In the case of a Non-Schedule SPA, progress payment may have to be paid when the architect certifies that the work for a particular stage has commenced, even through not completed. In the latter case, the developer is actually paid in advanced for works to be carried out.

Damages for late Delivery
In a Scheduled G agreement, damages for late delivery are based on 10% per annul of the purchase price, from the day immediately after the completion date to the actual date of the delivery of vacant possession.in a Schedule H agreement, an additional claim for liquidated damages can be made for non-completion of the common facilities.
In a Non-Schedule SPA, the right to claim for liquidated damages for the; late delivery will be dependent on the actual wording used in the agreement, and in some case, 10% per annul on the amount paid. It is common to find provisions where certain events will automatically entitle the developer to extend the date of the delivery of vacant of possession.

Developer's Consent to sell properties without titles
Currently, the consent fee payable to a developer for the sub-sale of a property purchased under a Schedule H agreement is RM500.
For a Non-Schedule SPA, a purchaser who wisher to sub-sell his property may have to pay a consent fee ranging from 1%-3% of the transaction price.

Utilisation of progress payments
In the case of the Schedule SPA, all progress payment received by the developer must be deposited into a housing Development account (HDA Account) under section 7A of HDA 1966 and the Housing Development(Housing Development Account) Regulations 1991 (HDA Account Regulations). Any withdrawal from the HDA account shall Supported by a certificate from the architect, Engineer or quantity surveyor, as the case may be, in charge of the housing development stating that payment is due to be made for a particular purpose. A copy of the notice of claim must be submitted concurrently to the controller.
The developer, may with the approval of the Controller, withdraw all monies remaining in the HDA Account after the completion of the development and after the solicitors for the developer have certified that the obligation of the developer in respect of the transfer of title for all the sale and purchase in the development has been fulfilled.
The Controller may use the monies in the HDA account to ensure the completion of the development.
The auditor of the developer is required to submit an annual report to the controller relating to the HDA Account and state, in his opinion, whether or not each deposit and withdrawal, the accounting and other records and the explanation given are in compliance with the HDA Account Regulations.
For the Non-Schedule SPA, there is no statutory check for the deposit and withdrawal of progress payments.

Grievances
A purchaser under the Schedule SPA may file complaints with the Controller for any dissatisfaction ralating to the property purchased. A claim against the developer may also be filed with the "Tribunal for Homebuyer Claims'(Tribunal). Such Claims may include liquidated damages for the late delivery, poor workmanship and non-compliance with building specifications.Currently, the Tribunal's jurisdiction is limited to claims of up to RM 25,000.
Such a purchaser may also file his claim against the developer in a civil court but if he chooses to files his claim with the Tribunal, then the Tribunal jurisdiction to hear the matter.
In the case of Non-Schedule SPA, any claim will have to be filed in the civil court.
A purchaser of property should read the clauses in the SPA and seek independent legal advice before he signs the SPA.

Better Protection For HouseBuyer

Amendment to the housing Development(Control and Licensing) Act approved by the cabinet include :

Increasing the claim value under the Tribunal for House Buyer Claim to Rm 50K from the present RM25K.
Increasing the Maximum RM 5K fine imposed on the those who fail to abide by the tribunal's award to RM10K.
To avoid complication of delay, house buyers would also able to take court action against developers without referring to housing loan institutions.
House buyers will be able to sell their units easily after signing the sale and purchase agreement.
Those who commit offences like not opening or maintaining the Housing Development Account or building without a licence would also face a higher penalty, which ranges from RM 50K to RM 250K.
Engineers, architects or trustees who flout the act could also be fined a maximum of RM 100K of jailed up to five years or both.
Those who flout the housing Developers (Control and Licensing) Regulations and the Housing Developers (Housing Development Account) Regulations would be fined RM20K, compared with the present RM 5K, or face up to five ears jail,compared with the current 3 years.
Incentives such as fast truck approval and a RM 200K deposit it exemption for the housing development licences and stamp duties for the developers who practise the "build-then-sell " concept.
A housing controller, who will be the ministry's secretary general, will be allow to freeze the housing development account of developers found be flouting the act.

The Last Amendment was in December 2002.
