A for March (first quarter),&lt;br /&gt;2. B for June (second quarter),&lt;br /&gt;3. C for September (third quarter), &amp;amp;&lt;br /&gt;4. Phone Scam</title><content type='html'>Its all started when I received a call from someone claimed that he was Maxis asking me to shutdown phone for 2 hours for 3g update to take place. As I was rushing for a meeting, I did not question any shutdown my cell phone.&lt;br /&gt; &lt;br /&gt;After 45 minutes I feel very suspicious since the caller did not even introduce his name. I quickly turned on back my cell phone back and I received several numbers of call; few numbers from my family members and the other numbers was from the number that call me before; 3954380.&lt;br /&gt;&lt;br /&gt;I called my parents and I was shocked that they sounded very worry asking me whether I am safe. My parents told me that they received a call from someone claimed that they have me with them and asking for money to let me free. &lt;br /&gt; &lt;br /&gt;The call was so real and my parents even heard my voice crying out loud asking for help. My parent was at the bank waiting for next call to proceed for money transfer. I told my parents that I am safe and asking them to lodge a police report.&lt;br /&gt;&lt;br /&gt;Right after that I received again call from the guy asking me to shutdown my cell phone for another 1 hour which this time I refused to do so and hung up. They keep calling my cell phone until the battery run down. I myself lodge a police report and was informed by the officer that this kind of scam always reported. MOST of the cases reported that the victim already transferred the money! And it is impossible to get back the money. Bank can only returned back the money if the owners of the account agree to do so or there is a court order.&lt;br /&gt;&lt;br /&gt;Guys, be careful that this kind of scam might happened to any of us!!!&lt;br /&gt;&lt;br /&gt;Those guys are so professional and very convincing during calls. If you asked to shutdown your cell phone for updates by the service provider, ASK AROUND! Your friend should receive the same call.&lt;br /&gt;&lt;br /&gt;Any Customer Service should introduce their NAME AT THE BEGINNING of the call. Ignore them if you don't get a name at the beginning of the call. If you received instructions from unrecognized number/person that you are not sure, make your own judgment. The BEST is DO NOT RESPONSE&lt;br /&gt;&lt;br /&gt;If you cannot pickup your loved one's call, DO GIVE A CALLBACK immediately! The team sits nearby in a car receiving the information transmitted wirelessly over weekends and evenings from equipment they install on the front of the ATM (see photos). If you see an attachment like this, do not use the ATM and report it immediately to the bank using the phone on the front of the ATM. The equipment used to capture your ATM card number and PIN are cleverly disguised to look like normal ATM equipment. A "skimmer" is mounted to the front of the normal ATM card slot that reads the ATM card number and transm its it to the criminals sitting in a nearby car. In the absence of consensus of mind among the personal representatives for the aforesaid transaction, directions of court are required.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:130%;color:#ff0000;"&gt;c) Grant of Probate Or Grant of Letters of administration extracted from court&lt;br /&gt;&lt;/span&gt;It is important that the personal representative has extracted the grant of Probate or Grant of Letters of administration from the court at the time of signing of the sale and purchase agreement. Without the Grant of Probate Or Grant of Letters of administration, the property cannot be registered in the name of the executor or the administrator and as a result of which, the instrument of transfer executed by the executor or administrator in favour of a purchaser cannot be registered in the land office when the time comes for the completion of the sale and purchase agreement.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:130%;color:#ff0000;"&gt;d) Whether application to court for sanction necessary&lt;br /&gt;&lt;/span&gt;In the case of an executor, the Probate and administration Act provides that the executor may sell the deceased’s property unless there is restriction in the deceased’s will for the executor to do so. In such circumstances, the executor needs not apply to court to empower him to sell the deceased’s property.&lt;br /&gt;Notwithstanding the aforesaid statutory provision, it has been the practice of some land offices that unless the deceased’s will expressly confer powers to the executor to sell the deceased’s property, those land offices will not register instrument of transfer signed by the executor in favour of a purchaser without an order of court authorizing the executor to do so. It is prudent for a purchaser to check with his lawyer the practice of the land office concerned and prepare he sale and purchase accordingly.&lt;br /&gt;In the case of an administrator, the probate and administration Act requires the administrator to apply to court to empower him to sell the deceased’s property.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:130%;color:#ff0000;"&gt;e) Conditional Contract&lt;br /&gt;&lt;/span&gt;It is common practice that when an order of court is required, the executor or the administrator will enter into a conditional sale and purchase agreement subject to the order of court being obtained within a certain period of time and to provide for the termination of S &amp;amp; P if the order of court cannot be obtained.&lt;br /&gt;It is important for the purchaser to make sure the completion date is calculated from the date his lawyer received the sealed copy of the order of court as the instrument of transfer needs to be accompanied by the sealed copy of order of court when it is presented to the Land office for registration.&lt;br /&gt;&lt;br /&gt;&lt;span style="color:#ff0000;"&gt;&lt;strong&gt;f) Beneficiaries’ Interest Versus Purchaser’s Interest&lt;/strong&gt;&lt;/span&gt;&lt;br /&gt;It has been decided by the court that a purchaser under a conditional contract was perfectly well aware that hia contact subject to the court’s approval and that the purchaser has taken the risk of losing their bargain if the court refused to grant such an approval. The Court, in considering the personal representative’s application for sanction to sell the deceased’s property, must protect the right of beneficiaries as opposed to the interest of the purchasers.&lt;br /&gt;&lt;br /&gt;&lt;span style="color:#ff0000;"&gt;&lt;strong&gt;g) Best Possible price&lt;/strong&gt;&lt;/span&gt;&lt;br /&gt;It is the duty of the personal representative to obtain the best possible price. The Court is concerned that the purchase price is a reasonable one not at the time of the sale and purchase agreement but the time of hearing of the application.&lt;br /&gt;There are cases where the court refused to sanction the sale by personal representative when the beneficiaries objected on the ground that the purchase price in the S &amp;amp; P is below market value.&lt;br /&gt;The Court had held that when most of the beneficiaries had not been consulted nor their consent been obtained, the personal representative should have applied the common sense rule of calling for a valuation report. That would have assisted the personal representative in considering whether the purchase price was reasonable as the best possible price.&lt;br /&gt;&lt;br /&gt;&lt;span style="color:#ff0000;"&gt;&lt;strong&gt;h) Beneficiaries’ Consent&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;One of the most common grounds to support such an application would be that all the  beneficiaries of the deceased’s estate consented to the sale.&lt;br /&gt;The Beneficiaries’ consent will have direct bearing on the outcome of the hearing of such an application. Under the Housing Development (Control &amp;amp; Licensing) Regulations 1989, the prescribed &lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-corrected" id="SPELLING_ERROR_3"&gt;format&lt;/span&gt; known as Schedule G is for landed property and Schedule H is for Condominium, apartment of flats (hereinafter both the 'schedule G and H SPA').&lt;br /&gt;&lt;br /&gt;Any amendment to the terms of the &lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-corrected" id="SPELLING_ERROR_1"&gt;schedule&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt; SPA requires the written consent of the Controller of Housing.&lt;br /&gt;&lt;br /&gt;A property constructed or intended for human habitation can only be offer for sale to the public after the developer's license and an &lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_2"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_2"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_2"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-corrected" id="SPELLING_ERROR_2"&gt;advertising&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt; permit.&lt;br /&gt;&lt;br /&gt;The Schedule SPA does not apply to properties like commercial properties which include serviced apartment, strata offices, commercial lots , factories etc.&lt;br /&gt;&lt;br /&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-corrected" id="SPELLING_ERROR_3"&gt;There&lt;/span&gt; are a number of differences between the Schedule SPA and a Non-Schedule SPA, and the illustration here not exhaustive but mere examples.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold; color: rgb(255, 0, 0);"&gt;Date For Delivery&lt;br /&gt;&lt;/span&gt;&lt;span style="color: rgb(255, 0, 0);"&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;Under the Schedule SPA, the effective date the purpose of the computation of the date of delivery of vacant possession is 24 months from the deposit is first paid to the developer &lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;for&lt;/span&gt; a Schedule G agreement, and 36 months for a Schedule H agreement.&lt;br /&gt;In the case of a Non-Schedule SPA, the effective date does not commence until the occurrence of certain events, E.g the approval of building plans, which the developer commonly refers to as "unconditional date'. The completion date may be extended for reason which developer &lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-corrected" id="SPELLING_ERROR_2"&gt;claims&lt;/span&gt; to be not within its control. As &lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-corrected" id="SPELLING_ERROR_3"&gt;the&lt;/span&gt; 'unconditional date' is often not known, it is almost impossible to compute the &lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-corrected" id="SPELLING_ERROR_4"&gt;delivery&lt;/span&gt; date for delivery vacant possession.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold; color: rgb(255, 0, 0);"&gt;Payment&lt;/span&gt;&lt;br /&gt;The purchase price to be paid under the Schedule SPA, consists of progress payment after the architect has &lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;&lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;certicied&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt; that particular stage of the work has been completed.&lt;br /&gt;In the case of a Non-Schedule SPA, progress payment may have to be paid when the architect certifies that the work for a particular stage has commenced, even through not completed. In the latter case, the developer is actually paid in advanced for works to be carried out.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold; color: rgb(255, 0, 0);"&gt; Damages for late Delivery&lt;/span&gt;&lt;br /&gt;In a Scheduled G agreement, damages for late delivery are based on 10% per &lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-corrected" id="SPELLING_ERROR_2"&gt;annul&lt;/span&gt; of the purchase price, from the day immediately after the completion date to the actual date of the delivery of vacant possession.in a Schedule H agreement, an additional claim for liquidated damages can be made for non-completion of the common facilities.&lt;br /&gt;In a Non-Schedule SPA, the right to claim for liquidated damages for the; late delivery will be dependent on the actual wording used in the agreement, and in some case, 10% per &lt;span onclick="BLOG_clickHandler(this)" class="blsp-spelling-corrected" id="SPELLING_ERROR_2"&gt;annul&lt;/span&gt; on the amount paid. Such Claims may include liquidated damages for the late delivery, poor workmanship and non-compliance with building specifications.Currently, the Tribunal's jurisdiction is limited to claims of up to RM 25,000.&lt;br /&gt;Such a purchaser may also file his claim against the developer in a civil court but if he chooses to files his claim with the Tribunal, then the Tribunal jurisdiction to hear the matter.&lt;br /&gt;In the case of Non-Schedule SPA, any claim will have to be filed in the civil court.&lt;br /&gt;A purchaser of property should read the clauses in the SPA and seek independent legal advice before he signs the SPA.&lt;br /&gt;&lt;br /&gt;&lt;span style="color: rgb(102, 102, 204);"&gt;
